Terms and Conditions

General

Where in these terms and conditions the expression “Met-tile” or "Business" is used, it shall be taken to mean Met-tile Roofing. “Goods” shall mean all goods and/or services supplied by Met-tile to the Customer, or ordered by the Customer but not yet supplied, and includes goods described on any quotation, invoice, purchase order or any other document including any recommendations and advice and over which Met-tile may intend to register a security interest. You the customer may be referred to in these terms and conditions as “the Customer”.

The Customer acknowledges that these general terms and conditions apply in relation to all sales of Goods by Met-tile to the Customer and to all orders placed with the Business. Prices are subject to change without notice.

These terms and conditions, are effective from the date of acceptance by the Customer and may be amended or outdated from time to time by notice given by the Company by any means. Unless or except specifically excluded in these terms, the Business retains any rights and remedies available in any prior or pre-existing agreement.

Met-tile Roofing reserves the right to discontinue or change any of the products, styles, colours, specifications, materials, services or other details referred to on the website at any time without notice.
Clerical errors are subject to correction and do not bind Met-tile. The Customer's rights under these General Terms and Conditions of Sale & Security Agreement are not assignable or transferable.

Met-tile is not responsible for the content of any other website linked to or from their site or any other form of transmission received from any linked site and disclaims all warranties, express and implied as to the accuracy, validity or suitability of the material contained on linked sites. Any links made available within this site have been provided purely as a customer service and are for your convenience only, and should not be interpreted as an endorsement by Met-tile for the content of the linked site.

We may from time to time conduct surveys that ask you for feedback on Met-tile products and services. We use that information to improve our product and service offerings. We do not release information from individual survey responses outside of Met-tile without prior permission.

If you send any communication, information or other material to Met-tile via electronic mail or otherwise, such communications will be treated as non-confidential and non-proprietary unless the information is personal or otherwise relates to your privacy.

If you send any such (non-private) information to Met-tile by any means it may be used by The Business for any purpose including but not limited to disclosure, transmission, publication, broadcasting, production and posting.

GST

Prices do not include GST, unless stated. The company will charge GST at the rate set by the Government in respect of any supply made to the Customer.

Quotes/Proposals

Any quotes provided by the Business remain open for acceptance for a period of 30 days from the date of quote. After this time the quote is voidable in which Met-tile may in its absolute discretion decide on the quotation and subsequently revise the price or any other of the conditions so quoted.

Cancellations

If the Customer chooses to cancel the service from this business after the quotation has been accepted by the Customer a small administration fee of $20 will be charged and invoiced.

The Company has the right to refuse sale of products and services to the Customer if there is signs of abuse to the business and/or their products and services in any form.

Payment Terms and Procedures

All goods must be paid in full before materials leave the Met-tile’s warehouse.

Terms of payment are 50% of the full amount stated on the invoice, which was approved by the Customer when accepting the quotation. 50% balance is due once the order is completed and ready to be delivered / picked up.

Production and Delivery

All times quoted for production and delivery are estimates only. Met-tile shall not be liable for any loss or damage, including consequential loss or damage, arising from delay in delivery and/or installation or failure to deliver goods, either in whole or in part.

The Company's obligation to deliver shall be discharged on arrival of the goods at the Customer's nominated delivery destination. Met-tile reserves the right to deliver by portion and each portion shall not entitle the Customer to renounce on the contract. Delivery will be deemed to have occurred when on-loaded at Met-tile's premises and all goods shall be the risk of the Customer after on-loading.

The Customer shall inspect the Goods upon delivery and will, within 48 hours, notify the Business of any defects, short deliveries or any failure to fulfill any quotation or order. The Customer will, within a reasonable time following delivery, produce evidence for any alleged defects. Should the Customer fail to notify the Business within the specified period then the Goods shall be deemed to be in compliance with the order and free from any defect whatsoever.

All Goods supplied by Met-tile shall be at the Customer's risk from the time of on-loading at the Business's premises. The legal and equitable title to and property in the Goods will not sent to the Customer until the Customer has paid all moneys owed to Met-tile Roofing.

The Customer agrees that Met-tile shall not be liable for any:

• Representation, promise or undertaking regarding the fitness or otherwise of Goods supplied by the Business unless it is made in writing or implied by law.
• Failure by the Customer to fix, install, erect, or maintain the Goods in accordance with any advice, recommendation, specification, information, assistance or service provided by the Business in relation to Goods sold or manufactured by it. The performance of steel products is dependent on the environment, product selection, handling, installation and maintenance. Before using Met-tile’s products please read the maintenance and care information located on the Met-tile Roofing website.

Default of the Customer

If the Customer defaults in any payment, commits any act of bankruptcy, or has assets frozen or restrained, Met-tile Roofing may at its discretion withhold delivery or cancel the contract without prejudice to its rights.

Claims

No claim by the Customer for failure to supply products conforming to the Customer's orders shall be recognised by the Business unless made in writing to Met-tile within 14 days after delivery of the Goods to the Customer.

No claim involving product replacement will be recognised by Met-tile unless Met-tile's agreement to the value of such claim is obtained immediately, if such a problem becomes evident and the Customer has demonstrated that he has taken all possible action to minimise the effect of such a claim and the Business has been given sufficient time to investigate and take such action it feels necessary to resolve the problem.

Claims for lost time or waiting time will not be approved by the Business. No claim will be recognised by the Business for any loss, damage or injury of any kind whatsoever, arising directly or indirectly from the Customer's failure to obtain independent professional and/or tradesman's advice in relation to the suitability of the Goods for any specific purpose. Met-tile shall not be liable to the Customer for any loss of profits or consequential, indirect or special loss, damage or injury of any kind whatsoever, arising directly or indirectly from any defect in the Goods or their installation (regardless of any express or implied terms, or by reason of the Company's negligent act or omission or otherwise at common law).

Returns

As goods are manufactured specifically for the customer, returns will only be accepted and a refund will accredited to the customer’s account if the customer agrees to organised for the materials to be delivered back to Met-tile's warehouse, in the condition the goods were delivered in. A 20% restocking fee will be deducted from the refund.

The refund will be issued to the Customer once the goods have been returned and check.
